2 Your Account

To use certain features of QwikGift, you must create an account. When doing so, you agree to:

• Provide accurate information — all registration details must be truthful and current
• Maintain security — you are responsible for safeguarding your login credentials and all activity under your account
• Age requirement — you must be at least 18 years old (or the legal age in your jurisdiction) to create an account
• One person per account — accounts are personal and may not be shared with or transferred to others without our consent

Notify us immediately if you suspect unauthorized access to your account.

3 Gift Vouchers

For Merchants

As a merchant using QwikGift to create and sell digital gift vouchers:

• You are responsible for the design, value, and terms of your vouchers
• Vouchers must comply with all applicable consumer protection and gift card laws in your jurisdiction
• You agree to honor all valid vouchers presented for redemption
• QwikGift provides the platform but is not a party to the transaction between you and the voucher purchaser/recipient

For Purchasers & Recipients

• Gift vouchers are subject to the terms set by the issuing merchant
• Voucher values, expiry dates, and redemption conditions are determined by the merchant
• QwikGift is not responsible for merchant failure to honor vouchers
• Vouchers are non-refundable once purchased, unless required by applicable law

4 Payments & Billing

All monetary transactions on QwikGift are processed through secure third-party payment providers.

• Pricing — all prices are displayed in the local currency and include applicable taxes unless stated otherwise
• Platform fees — merchants may be subject to platform fees as outlined in their merchant agreement
• Payment security — we never store full credit card details; all payment data is handled by PCI-DSS compliant providers
• Refunds — refund policies are set by individual merchants. QwikGift will facilitate refunds in accordance with applicable consumer laws
• Chargebacks — unauthorized chargebacks may result in account suspension pending investigation

5 Acceptable Use

You agree not to use QwikGift for any unlawful or prohibited purpose. The following activities are strictly forbidden:

• Fraud, money laundering, or any illegal financial activity
• Creating vouchers for illegal goods or services
• Attempting to hack, reverse-engineer, or compromise the Platform's security
• Scraping, crawling, or automated data collection without written permission
• Impersonating another person, business, or entity
• Distributing malware, spam, or harmful content through the Platform
• Circumventing any restrictions or limitations on your account

Violation of these terms may result in immediate account suspension or termination.

6 Limitation of Liability

To the maximum extent permitted by law:

• QwikGift provides the Platform "as is" without warranties of any kind, express or implied
• We do not guarantee uninterrupted or error-free service
• Our total liability for any claim arising from use of the Platform shall not exceed the fees you paid to us in the 12 months preceding the claim
• We are not liable for indirect, incidental, special, consequential, or punitive damages
• We are not responsible for the actions or omissions of merchants, including their failure to honor vouchers

Some jurisdictions do not allow certain liability exclusions. In such cases, our liability is limited to the greatest extent permitted by law.

7 Termination

Either party may terminate this agreement:

• You — may close your account at any time through your account settings or by contacting support
• We — may suspend or terminate your account if you violate these terms, engage in fraudulent activity, or if required by law

Upon termination:

• Your right to use the Platform ceases immediately
• Outstanding gift vouchers you have issued remain valid and must be honored
• We may retain certain data as required by law or legitimate business purposes
• Sections of these terms that by nature should survive termination will remain in effect
